These Affiliate Program Terms and Conditions (the "Agreement") are a legal agreement between VinCheck ("the Company", "we", "us") and you ("Affiliate", "you"). By signing up for the VinCheck Affiliate Program, you agree to be bound by the terms set forth below.
1.1. Auto-Approval: Enrollment is via auto-approval. However, we manually monitor all affiliates. We reserve the right to terminate your account immediately if your website, social media presence, or promotional methods are deemed unsuitable.
1.2. Prohibited Content: We do not allow affiliates who promote:
2.1. Cookie Duration: We use a 90-day tracking cookie. If a user clicks your link, you will receive credit if they purchase within 90 days, provided they do not click another affiliate's link after yours.
2.2. Attribution: We operate on a "Last Click" model. The last affiliate link clicked by the customer before the purchase will receive the commission.
2.3. Custom Tracking: Our tracking is handled by a proprietary system. While we strive for 100% accuracy, we are not liable for tracking failures caused by user browser settings, ad-blockers, or cleared cookies.
3.1. Tiered Model: Commission starts at a base rate of 25% per successful sale. VinCheck reserves the right to increase this percentage based on performance markers (sales volume) at its sole discretion.
3.2. Definition of Sale: A "Qualified Sale" is a completed purchase of a vehicle history report where the payment has been fully processed and not refunded or charged back.
4.1. Validation Period: All commissions are marked as "Pending" for 30 days from the date of sale.
4.2. Approval: After 30 days, commissions are automatically vetted by our system. If no refund or fraudulent activity is detected, they are marked as "Approved."
4.3. Payout Timeline: Approved commissions are paid on the 1st of the month, two months after the month in which the sale was generated.
Example: A sale made on January 15th will be approved on February 15th and paid out on March 1st.
4.4. Payment Method & Onboarding: All payments are processed via Stripe Connect. To receive payouts, Affiliates must complete the secure onboarding process via our platform, providing accurate identity and bank account details as required by Stripe. It is the Affiliate’s sole responsibility to ensure their bank information is up-to-date. VinCheck is not responsible for lost payments due to incorrect bank details or a failure to complete the Stripe verification process.
4.5. Minimum Threshold: The minimum payout threshold is £50. If your balance is below this, it will roll over to the next month.
5.1. PPC (Pay-Per-Click) Policy: Affiliates are strictly prohibited from bidding on "VinCheck" brand keywords (including variations or misspellings) on Google Ads, Bing Ads, or any other search engine. Violation will result in immediate termination and forfeiture of all commissions.
5.2. Coupon and Discount Sites: Affiliates operating primarily as "coupon" or "voucher" sites must obtain prior written consent from VinCheck before promoting our services.
5.3. Social Media Disclosure: Under UK law (ASA/CMA), affiliates must clearly disclose their relationship with VinCheck. Any post, video, or link shared on social media must include a clear disclosure such as #ad or #sponsored.
5.4. Spam: You may not promote your link via unsolicited commercial email (spam) or automated bot posting.
6.1. VinCheck grants you a non-exclusive, non-transferable, revocable right to use our logos, banners, and brand names solely for the purpose of promoting the program.
6.2. You must not alter our logos or brand assets without prior written approval.
7.1. VinCheck will not be liable for indirect, special, or consequential damages arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages.
8.1. Either party may terminate this agreement at any time with written notice.
8.2. Upon termination, any unpaid commissions earned through fraudulent or prohibited methods (as outlined in Section 5) will be forfeited.
9.1. This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
